In short
These terms form the agreement between you and InsuranceQuoteWidget for the website, the app at app.insurancequotewidget.com and the calculators and widgets you embed. By creating an account or using the service you accept them. If you accept on behalf of an agency or other business, you confirm that you can bind it, and "you" means that business.
InsuranceQuoteWidget provides software: embeddable needs calculators, widgets, a contacts list, lead email alerts and webhook delivery. It is a tool for insurance agencies and producers. We are not an insurance agency, broker or producer, and nothing in the service is an offer of insurance. See the insurance disclosures for the full statement.
You must follow the acceptable use policy. In short: no deceptive insurance advertising, no reselling leads of consumers who did not agree to it, no impersonating carriers or government programs, no unlawful discrimination, no scraping and no attacks on the service.
You own your content: your calculator settings, text, branding, custom CSS and the leads and contact records in your workspace. You give us a limited licence to host, process, display and deliver that content only as needed to run the service for you, including sending it to the destinations you configure.
Because the leads are yours, so are the obligations that come with them. You are responsible for:
Calculator results are estimates based on the inputs a visitor enters and on general assumptions. They are not quotes, rates, premiums, underwriting decisions, financial, tax or legal advice, or offers of insurance. Actual coverage needs and prices depend on carrier underwriting, state rules and individual circumstances. You must not present a calculator result as a quote or guarantee. You are responsible for checking that the calculators and your settings suit your market before you publish them.
We own the service, the calculators, the software, the design and our trademarks. Apart from the right to use the service under these terms, you get no rights in them. You may not copy, reverse engineer, resell or create competing products from the service, except where the law allows despite this restriction. If you send us feedback, we may use it without obligation to you.
On plans that include white-label features, you may present the calculators under your own brand and domain. You are responsible for your domain, your DNS settings, your sending email configuration and for making sure your branding does not infringe anyone else's rights.
The service connects to services we do not control, such as Stripe for payments and the webhook destinations you choose. Their terms govern your use of them, and we are not responsible for their availability or actions.
We may suspend or restrict an account, a calculator or a widget, with notice where practical, if we reasonably believe it breaks these terms or the acceptable use policy, creates a security risk, is used for fraud, or exposes us or others to legal liability. We may terminate for serious or repeated breaches or for non-payment. You may close your account at any time.
Before you close an account, make sure you have kept any leads you need, for example in the CRM your webhook delivers to. We delete workspace data after closure as described in the privacy policy, except what we must keep by law.
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that every lead will be delivered to a destination you configure, or that calculator results will be accurate for any particular person. See also the disclaimer.
To the extent the law allows:
These limits do not apply to your payment obligations or to liability that cannot be limited by law.
You will defend and indemnify InsuranceQuoteWidget against third-party claims arising from your content, your leads, your marketing calls, texts and emails, your failure to obtain consent or to hold required licences, or your breach of these terms.
These terms are governed by the laws of the United States and the state in which InsuranceQuoteWidget's operating entity is organized, without regard to conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days. Claims must be brought in the courts of that state, and each party consents to their jurisdiction.
We may update these terms. For material changes we will notify account holders by email or in the app before they take effect. Continuing to use the service after that date means you accept the new terms.
These terms, together with the policies they link to, are the entire agreement between us. If a provision is unenforceable, the rest remains in effect. A failure to enforce a right is not a waiver. You may not transfer your account without our consent; we may assign these terms to a successor. Neither party is liable for delays caused by events beyond its reasonable control.
