Glossary
Prior express written consent is the standard the Telephone Consumer Protection Act regulations require before a business places telemarketing calls or texts using an autodialer or an artificial or prerecorded voice. It must be a signed written agreement, which can be electronic, that clearly authorizes the seller to contact the person at a specific number.
The FCC's rules list what the disclosure must say, including that consent is not a condition of purchase. Courts and the FCC have revisited parts of the consent rules in recent years, so agencies should have counsel confirm their language and keep a record of when and how each consent was captured. This is not legal advice.
InsuranceQuoteWidget lead forms record the visitor's consent with the submission, and the agency writes its own consent wording. The lead consent page explains how that record is kept and why the agency, as the caller, owns the language.
